Under the incoming Trump administration, employers should prepare for heightened immigration enforcement and a potential increase in Form I-9 audits conducted by U.S. Immigration and Customs Enforcement (ICE), the Department of Homeland Security agency responsible for I-9 enforcement. During the first Trump administration, ICE audits increased significantly compared to prior years, although enforcement efforts then declined during the COVID-19 pandemic. With the anticipated return of more aggressive immigration policies, employers should consider proactively enhancing their I-9 compliance procedures to prepare for potential ICE audits.
